The new committee have been notified that a number of members have received Parking Charge Notices (PCN) from Civil Enforcement Ltd for parking in the Club car park during August and September 2025. We understand that the previous Committee agreed that a Permit Holders Only (Authorised Parking) APNR system be fitted and operated by Creative Car Park Ltd with entry of Car Registration details required into a touchscreen tablet onsite to avoid a PCN. We have requested clarification of the current contractual position, and a copy of the contract entered into from Creative Car Park and await a response.
At the recent meeting, a member advised that they had received a “Letter Before Action - Claim for Debt” due to non-payment of the PCN, advising that if the letter was ignored, proceedings would be issued. We have approached Creative Car Park Ltd, requesting that the PCN be waived, albeit we have been advised that this is not possible as Creative Car Park “understand this PCN is at legal stage and we’re unable to intervene. The driver will need to liaise directly with legal regarding this PCN as it is outside of our remit”.
Whilst the Committee is not able to provide specific guidance or advice, we would recommend that any members impacted by PCN / Letter before Action correspondence take their own Legal advice as there appears to be an unwillingness from Creative Car Park to engage directly with the Committee. Regrettably, we understand that there is only a 28- day period from any unauthorised parking where the Club has / had the ability via an online portal to cancel an agreed number of PCNs per month as outlined in the contract, and this period has expired.
