THE MUSIC IMBIZO 2026 MOOT COURT COMPETITION

SUBMISSIONS CLOSE: 31 JULY 2026

The competition is open for DELEGATES ONLY.

TEAMS: Limit to 2 people.

OBJECTIVES FOR PARTICIPANTS

Participants are expected to:
- Analyse copyright ownership, rights administration, and synchronization licensing under the Copyright Act 98 of 1978.
- Apply statutory interpretation principles to section 24(2) of the Copyright Act.
- Debate the legal and commercial consequences of defective music licences.
- Propose remedies that balance copyright as a property right with commercial fairness in the screen and music industries.

LEGAL ISSUES TO BE ADDRESSED

1. Rights and Ownership:
- Did Mountain Music acquire sufficient rights in Firelight to sue for infringement?
- Can an exclusive rights administrator enforce copyright in the same way as an owner?

2. Synchronization Licensing:
- Does a licence from a party who warranted ownership constitute valid authorisation?
- What is the legal effect of a defective synchronization licence?

3. Section 24(2) β€” Damages Defence:
- Does section 24(2) of the Copyright Act apply where a defendant knew copyright subsisted, but reasonably believed the licensor was authorised?
- Who bears the risk of a wrongly issued music licence?

4. Remedies:
- Is Mountain Music Publishing entitled to R11 000 000 in damages or only a reasonable royalty?
- Can good-faith reliance on warranties, invoices, and public conduct affect the remedy?
