Why is Cellar and Sudz Closed?
As many of you know, Cellar & Sudz has sadly and permanently closed. This has left many in our community wondering why this has happened. Rather then letting our local rumor mill fabricate the story, I would like you to know the truth.
We have been in a lawsuit from a fight that happened in 2016. The owner of the building was also named in the suit. The case was recently settled out of court by our insurance company. A settlement is the goal of most insurance lawyers and the companies they represent as it is a guaranteed conclusion and final price tag on the incident. The insurance attorneys elected to take that route, not us.
We opened and operated initially with only a beer and wine license until January 2016. That was when our application for a full liquor license was approved and our full license was granted. The original lease agreement with our landlord was signed in 2013 and stated the premise was to be used for the “sale of beer, wine and other related retail.”
Following the settlement, the lawyer representing our landlord sent us cease and desist letter disallowing us to continue to serving hard alcohol. After receiving the cease and desist letter, I sought legal counsel of my own. That attorney considered the lease agreement wording vague and considered our chances of successfully fighting the cease and desist possible, but not assured. However, as our lease agreement was set to expire a few short months later it seemed like a fight not worth waging.
We cut our losses and returned to the original Cellar and Sudz offerings. We sold and served beer and wine only, and considered the matter resolved. Shortly thereafter, our landlord informed us he would no longer allow anyone to serve ANY sort of alcoholic beverages on his property. This not only includes us, but future tenants as well. Now that all types of beverages our patrons enter to enjoy are off limits, we saw our options limited... and dwindling by the day.
We could move the business somewhere else locally and continue serving our community. We could take the harder and less desirable choice of closing for good. After much thought and consideration of all po
