The remote practice revolution began during the COVID-19 pandemic, but it continued Thursday to raise challenges for Florida’s civil justice system. At issue is a Civil Procedure Rules Committee proposal to amend Rule 1.700, (Rules Common to Mediation and Arbitration), and the concerns it raises for some practitioners.

During oral arguments before the Supreme Court, committee member Melisa Bodner told justices that sponsors want to update the rule to reflect modern remote practice, and to address a significant concern.

“Nearly every single member of our committee has experienced this particular issue, and that is, while we’re attending the mediation, one of the participants turns off their camera and mutes themselves.”
