Last Thursday September 5th Harty Brewing was unrightfully and immediately dispossessed of our Brewery at 146 Walden Way by the owner and developer of the property, Charter Homes.
The landlord, Charter, declined our offer to clear a default (in full) in exchange for re-possession of the property, blocking our ability to continue operation through the term of our lease.
Harty has filed a petition to open judgment against the possession. Instead of allowing a reasonable amount of time to settle the judgement before disturbing the premises, the landlord immediately destroyed thousands of dollars in beer inventory and seized brewery equipment, furniture, and fixtures that belong to Harty Brewing Company. A member of Charter’s Marketing team notified community members during the dispossession that a new tenant had already been lined up. It can be concluded that Charter Homes’ priority is not to collect the default and support the continued operation of its current tenant, but rather to move forward with their own interests without remorse for the likely demise of local small business.
We have decided to publicly share the details of the unfortunate situation in an attempt to remain transparent with the members of our local community where we personally live and raise children and who have supported our small business over the years.
