بيان للاتحاد الدولي للقضاة يدين فيه بشدّة
الحكم الاستئنافي الصادر ضدّ رئيس جمعيّة القضاة التونسيين
تعلم جمعية القضاة التونسيين أنّ الاتّحاد الدولي للقضاة أدان بشدّة في بيان نشره يوم الاثنين 06 جويلية 2026 الحكم الاستئنافي الصادر ضدّ رئيس جمعيّة القضاة التونسيين بالسجن لمدة عام والأمر بالنفاذ العاجل.
وجدّد الاتحاد الدولي للقضاة التعبير عن عميق انشغاله إزاء صدور هذا الحكم الاستئنافي ضمن إجراءات اعتبرها لم تلتزم بشكل مستمرّ بالضمانات الأساسية للإجراءات القانونية المستوجبة ولضمانات المحاكمة العادلة مما يُقوّض استقلال القضاء وسيادة القانون في تونس حسب الاتحاد.
وأضاف الاتحاد الدولي أنّه وعلى الرغم من بياناته السابقة التي ندّدت بالنمط المتكرر من الانتهاكات الإجرائية الجسيمة التي شابت التتبعات الجزائيّة ضد القاضي أنس الحمادي وهي انتهاكات قوّضت بشكل جوهري سيادة القانون وضمانات المحاكمة العادلة، فقد شابت إجراءات الاستئناف بدورها انتهاكات جسيمة أخرى للإجراءات القانونيّة المستوجبة وبدلاً من معالجة أوجه القصور التي سبق أن بيّنها الاتحاد الدولي للقضاة، كرّرت إجراءات الاستئناف نفس أوجه القصور الإجرائية وتمّ توظيفها لتأييد الإدانة مع الأمر النفاذ العاجل.
وأكّد الاتحاد الدولي أنّ إدانة القاضي أنس الحمادي قد تمّ تأييدها في الاستئناف دون استدعائه أو إعلامه أو منحه فرصة الاستماع إليه بالشكل القانوني. ومرة أخرى، تمّ تجاهل حقوق الدفاع بشكل ممنهج، ممّا يعكس حسب الاتحاد نفس النمط المستمر والمقلق من الانتهاكات الإجرائية التي اتسمت بها الإجراءات المتخذة ضده فيما يتعلق بدوره كرئيس لجمعيّة القضاة التونسيين.
وأشار الاتحاد الدولي أنّ التقارير أفادت أن قرار محكمة الاستئناف قد تمّ الإعلان عنه إعلاميّا عبر وسائل الإعلام قبل الإعلان عنه رسميّا ووفق القانون لكتابة المحكمة ومحامي الدفاع وهو ما يثير مخاوف إضافية وجدّية بشأن احترام الإجراءات القانونية الواجبة ونزاهة الإجراءات القضائية.
وأكّد الاتحاد الدولي أنّه لاحظ من خلال إجراءات المحاكمة حرمان القاضي أنس الحمادي من الضمانات الأساسية لمحاكمة عادلة، في قضية تُثير مخاوف جدية بشأن توظيف آليات التتبعات الجزائية واستغلالها في سياق الأزمة المتفاقمة التي تُعاني منها السلطة القضائية في تونس.
وجدّد الاتحاد الدولي التأكيد أنّ القاضي أنس الحمادي يُعدّ أحد أبرز رموز استقلال القضاء في تونس وأنّه قد تعرّض للملاحقة القضائية والاستهداف بسبب أنشطته المشروعة كرئيس لجمعية القضاة التونسيين، ولا سيما دوره في تمثيل القضاة والتعبير عن الرأي بخصوص المسائل التي تمسّ استقلال القضاء وسيادة القانون.
وأكّد الاتحاد الدولي أنّه يعبّر مجدّدا عن تضامنه المطلق والتام مع القاضي أنس الحمادي ويطالب السلطات التونسيّة بالوقف الفوري للتوظيف التعسفي للإجراءات الجزائيّة ضد القضاة الذين يمارسون وظائفهم المهنية المشروعة وبالاحترام الكامل لضمانات الإجراءات القانونية الواجبة واستقلال القضاء والامتثال لالتزامات تونس الدولية بموجب سيادة القانون والمعايير الدوليّة لحقوق الإنسان.
وأضاف الاتحاد الدولي للقضاة أنّه يواصل متابعة هذه القضية عن كثب وأنّ الاتحاد يبقى ثابتا في الدفاع عن القضاة الذين يتعرضون لأعمال انتقامية بسبب ممارستهم المشروعة لواجباتهم المهنية.

Déclaration de soutien au juge Anas Hmedi
L’Union Internationale des Magistrats (IAJ/UIM) a été informée que la peine d’un an d’emprisonnement prononcée à l’encontre de notre collègue, le juge Anas Hmedi, Président de l’Association tunisienne des magistrats, a été confirmée par la Cour d’appel de Tunis le 1er juillet 2026, avec exécution immédiate.
L’Union Internationale des Magistrats réitère sa profonde préoccupation face au fait que cette décision a été rendue dans le cadre d’une procédure qui n’a cessé de méconnaître les garanties fondamentales du droit à un procès équitable, portant ainsi une nouvelle atteinte à l’indépendance de la justice et à l’État de droit en Tunisie.
Malgré les précédentes déclarations de l’UIM dénonçant et condamnant le caractère systématique des violations graves de procédure ayant entaché les poursuites pénales engagées contre le juge Hmedi — violations qui ont profondément compromis l’État de droit et les garanties d’un procès équitable — la procédure d’appel a été, elle aussi, marquée par de nouvelles atteintes sérieuses aux règles du procès équitable. Au lieu de remédier aux manquements déjà identifiés par l’UIM, la procédure d’appel a reproduit les mêmes irrégularités et a été instrumentalisée pour confirmer la condamnation tout en ordonnant son exécution immédiate.
La condamnation du juge Anas Hmedi a été confirmée en appel sans qu’il ait été régulièrement convoqué, informé ou mis en mesure de présenter sa défense. Une fois encore, les droits de la défense ont été systématiquement ignorés, reflétant le même schéma persistant et alarmant de violations procédurales qui caractérise les poursuites engagées contre lui en lien avec ses fonctions de Président de l’Association tunisienne des magistrats.
En outre, la décision de la Cour d’appel aurait été communiquée aux médias avant d’être notifiée, conformément à la loi, au greffe et aux avocats de la défense. Une telle conduite soulève des préoccupations supplémentaires et graves quant au respect du procès équitable et à l’intégrité de la procédure judiciaire.
Tout au long de ces procédures, l’UIM a constaté que le juge Anas Hmedi a été privé des garanties fondamentales d’un procès équitable dans une affaire qui suscite de sérieuses inquiétudes quant à la manipulation et à l’instrumentalisation des mécanismes de justice pénale dans le contexte plus large de la crise persistante qui affecte la justice en Tunisie.
Le juge Anas Hmedi demeure l’un des principaux symboles de l’indépendance judiciaire en Tunisie. Il a été poursuivi et ciblé en raison de ses activités légitimes en tant que Président de l’Association tunisienne des magistrats, notamment pour avoir représenté les magistrats et exprimé des positions sur des questions touchant à l’indépendance de la justice et à l’État de droit.
L’Union internationale des magistrats réaffirme sa pleine solidarité avec le juge Anas Hmedi et appelle les autorités tunisiennes à mettre immédiatement fin à l’usage abusif de procédures pénales contre des magistrats exerçant leurs fonctions professionnelles légitimes, à respecter pleinement les garanties du procès équitable et de l’indépendance judiciaire, et à se conformer aux obligations internationales de la Tunisie en matière d’État de droit et de droits de l’homme.
L’UIM continuera de suivre cette affaire de près et demeurera résolue à défendre les magistrats qui font l’objet de représailles pour l’exercice légitime de leurs fonctions professionnelles.

Statement in Support of Judge Anas Hmedi
The International Association of Judges (IAJ/UIM) has been informed that the one-year prison sentence imposed on our colleague, Judge Anas Hmedi, President of the Tunisian Judges Association, was upheld by the Court of Appeal of Tunis on 1 July 2026, with immediate enforcement.
The Association reiterates its profound concern that this decision was reached in proceedings that have consistently failed to comply with the fundamental guarantees of due process and a fair trial, thereby further undermining judicial independence and the rule of law in Tunisia.
Despite the IAJ's previous statements denouncing and condemning the consistent pattern of serious procedural violations that have marked the criminal proceedings against Judge Hmedi—violations that fundamentally undermined the rule of law and the guarantees of a fair trial—the appeal proceedings were likewise marred by further serious breaches of due process. Rather than remedying the deficiencies previously identified by the IAJ, the appeal proceedings repeated the same procedural shortcomings and were instrumentalized to uphold the conviction while ordering its immediate enforcement.
Judge Anas Hmedi's conviction was upheld on appeal without his being properly summoned, notified, or given the opportunity to be heard. Once again, the rights of the defence were systematically disregarded, reflecting the same persistent and alarming pattern of procedural violations that has characterized the proceedings against him in connection with his role as President of the Tunisian Judges Association.
Furthermore, the decision of the Court of Appeal was reportedly communicated to the media before it was formally notified, in accordance with the law, to the court registry and to the defence lawyers. Such conduct raises additional and serious concerns regarding respect for due process and the integrity of the judicial proceedings.
Throughout these proceedings, the IAJ has observed that Judge Anas Hmedi has been deprived of the fundamental guarantees of a fair trial in a case that gives rise to serious concerns regarding the manipulation and instrumentalization of criminal justice mechanisms within the broader context of the ongoing crisis affecting the judiciary in Tunisia.
Judge Anas Hmedi remains one of the leading symbols of judicial independence in Tunisia. He has been prosecuted and targeted because of his legitimate activities as President of the Tunisian Judges Association, particularly his role in representing judges and expressing views on matters affecting judicial independence and the rule of law.
The International Association of Judges reiterates its full solidarity with Judge Anas Hmedi and calls upon the Tunisian authorities to put an immediate end to the misuse of criminal proceedings against judges exercising their legitimate professional functions, to fully respect the guarantees of due process and judicial independence, and to comply with Tunisia's international obligations under the rule of law and international human rights standards.
The IAJ will continue to closely follow this case and will remain steadfast in defending judges who are subjected to reprisals for the legitimate exercise of their professional duties.
