đŸ“„ Dear Rotterdam Pride and Gemeente Rotterdam,

❗Through this letter we want to address the board and contractors involved in organising Rotterdam Pride 2020, the Gemeente Rotterdam and the people that facilitated the Pride 010 Network meeting last Wednesday, 1st of July (on the day of Keti Koti no less). This letter is in no way directed to condemn the people, participants and artists who have taken part in the Rotterdam Pride, except for the threatening presence of the mentioned groups.

❗After Wednesday’s Pride network 010 meeting, in which representatives of some DIY non-profit q***r organisations were invited to attend, while other voices like Resist their Reignbow, more critical of the Rotterdam Pride organisation were left out, we decided to reach out to the broader q***r community and collectively write this letter.

❗During the Pride 010 Network meeting Pride Rotterdam was discussed. Many of the present organisations feel Rotterdam Pride has failed them and a big part of the LGBTQIA+ community.

❗For example by the presence of Dutch White Nationalists organisations such as Roze Leeuw and Pegida, both online and offline at Rotterdam Pride. Their racist and islamophobic ideology is against what we feel is one of the most important pillars of pride: inclusivity. While they were allowed to walk the Pride Walk under the banner of ‘free speech’, Reclaim Our Pride was physically and violently isolated from the march by the police and literally put in the back.

❗Furthermore the commercialisation of Rotterdam pride by, for example, partnering up with KPN, Unilever and ABN Amro. After repeatedly having been asked not to by the original organisers. The reason for this being that those organisations do not have policies or practices that in any way reflect their support of q***r communities. We feel it is important to partner up with organisations who also support the LGBTQIA+ community when it is not pride month, even if this means having a smaller budget.

❗Lastly, we miss safety, accountability and transparency. The current board should be held accountable for the injustices stated above (and the ones that were not mentioned in this letter). There should be transparency about the way the board is elected, the way the organisation is structured and how the decision making process works.

❗Actions speak louder than words, which is why we demanded the following actions during the Pride 010 Network meeting:

📱POSTPONE THE BOARD VACANCY. Make an actual effort to reach the Rotterdam q***r communities. (posting something on Instagram and saying it is “ open” is not that). You are being paid to reach out to and know the LGBTQIA+ community, you simply cannot leave out the multiple grassroots organisations this city has.

📱CANCEL THIS YEAR’S ROTTERDAM PRIDE event. Use the resources to facilitate a town hall type meeting where Rotterdam Pride will listen to the local q***r communities, apologise and make a plan for resolution and reparations. (if COVID has shown us anything it is that events can be cancelled)

📱RELIEVE THE ENTIRE current BOARD of its members. In order to diversify and have more inclusive policies, the governing body must be more representative of the communities they wish to include. Make an effort to form a bigger board (more than 3 members) that holds space for multiple voices.

📱BE TRANSPARENT ABOUT YOUR GOVERNANCE MODEL. And make an effort to apply good governance guidelines:
- Make the composition of the board visible on the website
- Articulate the mandates, responsibilities and time restrictions of the board
- Update your mission and vision with the new board and tell us how you will implement these.
- Have open hearings where you listen to the concerns and criticism from the local community.

📱ADOPT an INCLUSIVE and TRANSPARENT SELECTION PROCEDURE for the new board vacancies. Meaning:
- Form a selection committee, make sure this committee also is representative of various communities, and community organisations.
- Make a proper board description: the roles, the responsibilities, the required skills, knowledge and competencies. The same goes for the selection committee.

📱And more generally, we advocate for you to
LISTEN to your community, meet up with grassroots organisations, work with these communities, rather than thinking for them.

📱INCLUDE grassroots organisations and especially people who face adversity the most in our country.

📱ACKNOWLEDGE the history and painful developments between Rotterdam Pride and grassroots organisations, and declare a proposal for resolution.

📱Make Rotterdam Pride a manifestation of intersectional and progressive thinking which operates holistically, and be careful how and where you spend your money.

❗ If you want to repair the relationships you severed, show us how you are willing to change: start by postponing the board vacancy.

Statement from * about the Utrecht Pride Demo:

Yesterday (28.06) approximately 50 - 75 people answered niet normaal* and Stichting Prisma Groep’s call to celebrate 2020 pride by marching to commemorate 1969’s Stonewall Uprisings. Our desire was to honor and acknowledge our debt to the trans women of color - Marsha P. Johnson, Silvia Rivera, StormĂ© DeLarverie, Miss Major Griffin-Gracy - who led the Stonewall anti-police riots which were sparked in response to the NYPD’s ongoing harassment, surveillance and repression of gay, le***an, q***r, trans and gender non-conforming people. At the same time, we aimed to make clear that this specific history of LGBTQI+ collective resistance is, and always has been, intertwined with legacies of racist and imperialist policing and state violence. While these connections have consistently been left out from contemporary Pride marches and celebrations, the current wave of anti-police brutality demonstrations and upsurge of anti-racist movements across the globe forces us to keep striving for a more intersectional LGBTQI+ community and politics.

The police harassment and interference with the pride demonstration on June 28th is, in light of Stonewall’s history and legacy, only the most recent instance in a long history of harassment and violence against LGBTQI+ people by the police. After the introduction by niet normaal* and Stichting Prisma Groep, two of the police officers monitoring the demonstration told the organizers that some of the banners, signs and shirts contained messaging that we did not explicitly ask for in our gemeente permit request. The officers then told us we would have to remove all messaging that included pro-refugee, Zwarte Piet is Racisme, and Black Lives Matter references in order to march. In their own words, they were not up for a ‘Poolse landdag,’ (trans. ‘Polish landday’), which is a racist xenophobic saying that means a wild, unruly gathering. These statements and actions make clear how necessary and relevant a q***r and trans anti-racist politics is to our context in Utrecht as well as to LGBTQI+ struggles the world over.

The two main police representatives initially framed their argument as a compliance issue - our demonstration was approved as a pride demonstration, and therefore could only include messages and information about LGBTQI+ issues. When it became clear that this line of reasoning had no actual basis of support, they began to argue that they could not guarantee our safety during the march if we displayed any anti-racist or pro-refugee statements. The organizers of the demo, supported by the participants, refused to comply. The police do not have the right to censor or control the content of a political demonstration. The fact that the police only found problems with anti-racist slogans - specifically targeting anything referencing anti-Zwarte Piet & BLM - illustrates the pervasive anti-black racism that the police are already well known for. It also speaks to how the state and its institutions attempt to reduce our collective struggles into single issue politics. The words and actions of these officers show a narrow understanding of what constitute LGBTQI+ issues. They also show a complete ignorance of intersectional politics, which, in our eyes, should always be essential to our understandings and celebrations of Pride. The actions of the police here shows the necessity and relevance of our march in Utrecht and beyond.

After an hour delay, we were finally allowed to march. As we left Moreelsepark, the police forcefully confiscated one of our banners that said “All C***s Are Beautiful.” In their communication on their own media and to press, the police department presented an entirely different justification for these actions, stating that the reason for their disruption of our demonstration was that the confiscated banner’s text, when abbreviated, spells out the acronym ACAB, which can also spell ‘All Cops Are Bastards,’ and to which they took offense. We have our conversation with both of the police representative on video, where it is clear that the anti-racist messaging was their original target and problem and not the ‘offensive’ banner. In fact, during their initial explanation of why we were obligated to censor / remove banners and signs displaying anti-racist or pro-refugee messages, the police representatives specifically pointed out the “All C***s Are Beautiful” banner as a good example of what proper Pride messaging should be.

All of this resulted in a situation so unsafe and unpredictable that bi-cultural q***res needed to leave the march and could no longer participate. Now it is up to the municipality to take responsibility for the way their police department has harassed, disrupted and tried to end our peaceful demonstration and celebration, once again showing their true racist colors.

We are angry. We are hurt. We are strengthened in our beliefs that what we stand for still needs to be fought for with tooth and hair. Our protest targeted the racist police violence waged against our q***r kin past and present. The events from yesterday underlined the importance of that struggle.

Geachte Minister van Justitie en Veiligheid. Beste Kamerleden. Geachte senatoren,

Ik heb vernomen dat de Tweede Kamer een wetswijziging heeft geaccepteerd die de straf op politiegeweld richting burgers voor agenten versoepelt. En dat die nu bij de Eerste Kamer ligt. Ik kijk er met afschuw naar en maak me ernstig zorgen over deze ontwikkelingen die tot dodelijk politiegeweld kunnen leiden, met milde consequenties voor agenten die zich daar schuldig aan maken. Ik vraag u hoe u van plan bent de rechten van burgers te beschermen en etnische profilering tegen te gaan.

Problemen binnen de politie

Ik stel geenszins dat alle politieagenten zich bij voorbaat schuldig maken aan politiegeweld. Maar uit onderzoek blijkt wel dat er flinke misstanden plaatsvinden. Volgens het NRC stelde het interne onderzoeksbureau van de politie (VIK) dat er op bureau de Hoefkade "sprake is van ernstige discriminatie, geweld, ongewenste omgangsvormen en groepscultuur onder politieagenten". Klokkenluiders zoals Fatima Aboulouafa en Carel Boers hebben deze cultuur aangekaart bij de teamleiding, de eenheidsleiding en de korpsleiding. De NOS: "Ondanks signalen van medewerkers grepen leidinggevenden niet in." Aboulouafa zag zich genoodzaakt te vertrekken, nadat agenten die zich schuldig maakten aan politiegeweld soepeler gestraft werden, zoals in NRC gemeld.

Ontoelaatbaar taalgebruik

Problematisch taalgebruik onder agenten is een hardnekkig verschijnsel. Volgens Carel Boers (2019) worden burgers door agenten "kankermongolen, kankerlijers, pauper-allochtonen, kankervolk, kutvolk en kutafrikanen" genoemd. Dat is geen nieuws, want onderzoeker Wouter Landman schreef al in 2016 dat de politie spreekt over "(foute) gasten, eencelligen, zigeuners, junks, tokkies, kampers, plot’n volk en kakkerlakken. Dat was toen ook geen nieuws, want in 2012 schreef onderzoeker Sinan Cankaya al dat de politie spreekt over 'negers' en naar Marokkaanse Nederlanders verwijst als NATOS: Noord Afrikaanse teringlijers op sportschoenen.
De kwaliteit van de rechtsstaat wordt bedreigd door politieagenten die zich schuldig maken aan ernstige discriminatie, geweld, ongewenste omgangsvormen en machtsmisbruik. Het dient de samenleving en burgers niet wanneer degenen die hen horen te beschermen, ook een gevaar kunnen vormen.
Bescherming tegen machtsmisbruik van de politie is verankerd in artikel 11 van de Grondwet, namelijk de bescherming van lichamelijke integriteit en in artikel 3 EVRM. Dit kun je o.a. teruglezen in het rapport van de nationale ombudsman uit 2013 over verantwoord politiegeweld. Daarnaast is er artikel 1 uit de grondwet die beschermt tegen discriminatie en art. 14 uit het EVRM, waar ook op gelet zou moeten worden, maar nu niet het geval lijkt.
En de scheiding der machten (trias politica) komt in gevaar als de rechterlijke macht niet altijd de kans krijgt om te toetsen of er rechtmatig is gehandeld.

Achtergrond wetswijziging

Het gaat hierbij om een wetswijziging van het Wetboek van Strafrecht in verband met het opnemen van een specifieke strafuitsluitingsgrond voor opsporingsambtenaren die geweld hebben gebruikt in de rechtmatige uitoefening van hun taak en een strafbaarstelling van schending van de geweldsinstructie en wijziging van het Wetboek van Strafvordering in verband met het opnemen van een grondslag voor het doen van strafrechtelijk onderzoek naar geweldgebruik door opsporingsambtenaren (geweldsaanwending opsporingsambtenaar).
Verzoek
Als deze wetswijziging aangenomen wordt, betekent dat dat de politie - die al een machtsmonopolie heeft - weg kan komen met grof geweld. U heeft ongetwijfeld de protesten in de Verenigde Staten gevolgd naar aanleiding van de moord van George Floyd door politieagent Derek Chauvin. En de protesten die daar wereldwijd op volgden om institutioneel racisme en politiegeweld aan te kaarten.
De situatie in de VS en in Nederland zijn weliswaar niet hetzelfde, maar ook hier vinden er incidenten plaats, waarbij zwarte mensen en mensen van kleur etnisch geprofileerd en met buitenproportioneel geweld aangepakt worden. Tevens worden ook mensen met een beperking vaker hardhandig behandeld door de politie. Ik hoop dat u niet wil wachten totdat de situatie zodanig escaleert dat het wél vergelijkbaar is met politiegeweld in de Verenigde Staten voordat u ingrijpt om institutionele veranderingen te maken.
Als bezorgde en betrokken burgers hoop ik dat u mijn signaal ter harte neemt en de wetswijziging heroverweegt. De Eerste Kamer kan dit nog afwijzen. Ik verwacht in ieder geval dat u publieke verantwoording aflegt, omdat in ons optiek mogelijke discriminatie en machtsmisbruik onvoldoende serieus worden genomen bij het aannemen van deze wetswijziging.

The Hungarian government Tuesday, 31 March, released a draft omnibus bill simultaneously amending many laws and provisions. One of the laws proposed for amendment relates to legal gender recognition for trans people – proposing to replace “sex” with “sex assigned at birth” in the national registry and on identity documents, as cited in Article 33 of the omnibus bill.

The amendment comes at a time when the Hungarian Parliament has given Prime Minister Viktor OrbĂĄn power to rule by decree indefinitely because of the COVID-19 crisis, which means he no longer needs to consult other lawmakers before making policy decisions.

Call out the government to respect trans people and their rights. Help us to stop this extreme rollback in human rights law!
