We have received the following advice from Rossendale Council:
"The Council panel has reviewed the decision by the Clog Market not to renew the weekly/ monthly permit for cabins 60 and 61 at Rawtenstall Market. Under the conditions of the permit there was no guarantee of security of tenure.
After consideration the panel believes that there were sufficient grounds not to renew the licence.
We would however, consider a new licence application under strict conditions for a possible stall at either Bacup or Haslingden markets but this would require a new alcohol licence application, suitable nominated person and professional management of the stall."
We do not accept that established legal principles have been properly considered in their decision or that they have taken into account serious issues raised by ourselves about the market management.
We were given no advise of any allegations against the running of The Cabin Nano Bar prior to the meeting. During the meeting we were only quickly verbally read out parts of one single email from the market management. No evidence at all supporting any of the allocations which were all insignificant and which we refute.
In fact, during the meeting the Officers told us if these allegations had been made against any other bar they would not be an issue at all and certainly not reason in any way to permanently close them down.
Neither to we accept that we were on a weekly/monthy permit as the intention of the parties from the outset was that The Cabin was to be on a lease as shown on the attached screen grab of message received from the Market management, which is the basis on which we invested considerable sums and time.
We are now waiting on legal advise and are considering options available to us. We would like to assure the one thousand three hundred and sixty three people who have so far signed our petition that the campaign to Save The Nano Bar continues.
